Colette Phelps, 28, of Los Gatos has been charged with committing “lewd and lascivious acts” against a student from one of the Stratford Schools in San Jose. No information about the student has been released, except that the child was 14 or 15 years old. The Mercury reports that some accounts from the school say that the victim was male.
Police were first notified of the case on June 1, and arrested Phelps that same day. The school placed her on indefinite leave, and as details emerged, she was terminated, says Sherry Adams, founder of the Stratford network, which operates 13 schools covering preschool to middle school.
Phelps appeared in the Santa Clara County Superior Court for the first time on Wednesday and was charged with two counts of lewd and lascivious behavior with a minor, considered a felony. If convicted, Phelps could face up to three years, eight months in prison and have to register as a sex offender.
Her attorney, Steven Clark, responded to the charges by saying, “Ms. Phelps has had significant personal and medical conditions in her life.” He did not elaborate on how these conditions would be used to defend her alleged behavior.
