A West San Jose Panda Express is reportedly being sued by the federal government for giving its Asian employees cushier jobs while Latino workers cleaned toilets, tables and counters.

The U.S. Equal Employment Opportunity Commission filed a federal lawsuit saying the general manager of the Panda Express violated the Civil Rights Act of 1964 by discriminating its employees based on ethnicity.

“Hispanic workers who worked as counter help were required to clean the bathroom, tables and counters, while Asian employees were permitted to simply stand around and watch,” the federal agency’s Bay Area office said in a statement.

The Rosemead-based Chinese food chain has had problems with this San Jose location in the past. In September, it was sued for firing an employee because she complained about a co-worker’s “inappropriate sexual behavior.”
