Los Gatos mom Sara Cole, 48, was convicted of misdemeanor child molestation on Thursday. Cole was accused of having sex with her son’s sixteen-year-old friend. She was found not guilty of two felony charges of child molestation.
The boy claimed in court that he lied to the police in his original statement and that he had intercourse with Cole between thirty and forty times. The jury rejected the boy’s testimony, however, and ruled on two separate instances that there was insufficient evidence that the two had sex. In a third charge of having sex with a minor, the jury voted 11-1 for a felony charge, but that was not enough to convict her.
Although she was not convicted in the felony charges, Cole must still register as a sex offender. The county could also decide to retry her for the hung charge, but it has not yet decided whether to pursue this.
